These General Conditions regulate all legal relationships that arise from the contracting processes carried out between the users or clients of the website located at the url www.cutfy.eu, property of Mr Brightside León SL
By accepting these General Conditions, the client declares that he has the necessary legal capacity to contract in the country of which he is a national, this age being 18 years in Spain. If the client is a legal entity, the natural person acting on its behalf declares, under its exclusive responsibility, to have the corresponding powers of representation.

Applicable standards
These General Conditions are subject to the provisions of Law 7/1998, of April 13, on General Contracting Conditions; Royal Legislative Decree 1/2007, of November 16, which approves the Consolidated Text of the General Law for the Defense of Consumers and Users and other complementary laws; Regulation (EU) 2016/679, of April 27, General Data Protection (RGPD) and other applicable regulations on the matter; Law 7/1996, of January 15, on the Regulation of Retail Trade; and to Law 34/2002, of July 11, on Information Society Services and Electronic Commerce.
These General Conditions are also subject to Royal Decree-Law 19/2018, of November 23, on payment services and other urgent measures in financial matters.
Modification of the General Conditions
Mr Brightside León SL . may modify, without prior notice, these General Conditions in order to improve the services and/or products offered through the website, without in any case this modification being able to retroactively affect the contracts already concluded.

The characteristics of the products and services offered and marketed, through the web or telephone, by Cutfy, are detailed in the category where each of them is included. Likewise, if there are any specific conditions in the contracting of any of these products and/or services, these will be specified and detailed in the section referring to the specific product and/or service.
Electronic contracting procedure
To place an order on Cutfy it will be necessary to carry out the following steps:
- Choose your product (or products) on the website and click on "Add to cart" to add them to the order.
- Display the shopping cart by clicking on the cart icon (at the top right) and then click on "Finish" in the drop-down menu that appears.
- On the "Order Summary" screen we can review the products to purchase and we must click "Finish" again if we want to make the purchase.
- Finally we will have a last screen where we must fill out the shipping, billing, shipping method and payment information.
- Once we fill out the information from the previous point on the "Purchase Process" screen, we will click on "Finish the purchase".
- Depending on the payment method chosen, we may have to complete the payment on the payment gateway of the payment method or this point may not be necessary.
- Finally we will end up on a screen where the order will be confirmed and a copy of the purchase-sale contract and summary of the order will be sent to us by email.
Please note that if payment is made by debit or credit card, the charge will be made as soon as the payment process is completed.
Price
In each of the product categories its retail price appears, with taxes included.
In certain assessed cases, the exact price that will be charged to the customer may entail the payment of shipping costs, which are specified in the section referring to shipping, also when viewing their basket once they have added a product, the customer may have all relevant information regarding shipping costs. In the event of a discrepancy between the price indicated for shipping costs in the corresponding section of the website and that indicated at the time of finalizing the order in the basket, the price indicated at the end of the order always prevails in all cases.
Shipment
At Cutfy you can only purchase products that we can deliver within a reasonable time. The product sheet will indicate whether it is available or not.
Regarding the forms, deadlines and shipping costs, what is reflected in the corresponding section of our website will be followed.
From the company we will do everything possible so that the transport companies comply with the pre-established deadlines, however, in the event that for reasons beyond the control of Mr Brightside León SL . If these are not met, in no case will we be responsible for the delay and therefore shipping costs will not be refundable.
The order will be deemed delivered when the delivery note appears signed in the courier company's systems.
We are not responsible for possible extra costs derived from customs.
Use of the service and responsibilities
Mr Brightside León SL . does not guarantee the permanent availability of the products and/or services offered, being exonerated from any type of liability derived from possible damages and/or losses that may be caused, by way of example and not exclusively, due to errors or omissions in the contents, lack of product availability, transmission of viruses or any other technologically harmful or harmful program or material that may affect your computer equipment as a result of the use of this website. However, all measures deemed appropriate will be adopted to avoid this type of situation to the extent possible.

Nullity and ineffectiveness of the Clauses
If any clause included in these General Conditions is declared, totally or partially, null or ineffective, such nullity or ineffectiveness will affect only said provision or the part thereof that is null or ineffective, the General Conditions subsisting in everything else, such provision, or the part thereof that is affected, being considered not in place.
Applicable regulations, conflict resolution and jurisdiction
The regulations applicable to this contract will be the current Spanish regulations. Likewise Mr Brightside León SL . makes online conflict resolution available to website users.
